Suspended KZN Correctional Services Head Mnikelwa Nxele May Face Lifestyle Audit
National Correctional Services Commissioner Makgothi Thobakgale told the Madlanga Commission that Mnikelwa Nxele was the only senior manager who did not disclose his financial interests over the past two financial years.
KwaZulu-Natal Correctional Services head Mnikelwa Nxele may face a lifestyle audit after national commissioner Makgothi Thobakgale told the Madlanga Commission that Nxele had not disclosed his financial interests during the past two financial years.
Thobakgale was giving evidence before the commission on Thursday when he said all senior managers, apart from Nxele, had made the required financial-interest disclosures during the period.
Nxele is facing fraud-related allegations linked to claims that he received more than R14 million from a company associated with Bosasa in connection with a 2004 tender. Nxele has denied the allegations.
He has been suspended and reinstated several times over the past decade and has received compensation during that period.
Nxele's Suspension And Whistleblower Claim
Nxele has been on his current suspension since May last year.
At the time, he claimed he was being targeted after raising allegations of tender fraud involving Thobakgale. The national commissioner denied those allegations when questioned at the commission.
Thobakgale also rejected the suggestion that Nxele had been formally recognised as a whistleblower or that the national commissioner had been found to have been involved in the alleged activities.

“There was no finding that he was a whistleblower and there was no finding that the National Commissioner was involved in those types of activities.”
The evidence at the commission therefore placed the disputed allegations against Thobakgale separately from the issue of Nxele's suspension and the findings, or absence of findings, referred to by the national commissioner.
Nxele's Criminal Case
Nxele is due back in the Pietermaritzburg Magistrates Court on 26 November.
The court proceedings concern the allegations against him, which he denies. The evidence before the Madlanga Commission regarding his financial disclosures and the possibility of a lifestyle audit is separate from a determination of his guilt or innocence in the criminal matter.
