Sibiya Remains In Custody As Bail Hearing Continues Over Rape And Human Trafficking Charges

Suspended Deputy National Police Commissioner Shadrack Sibiya will remain behind bars after appearing in the Randburg Magistrates Court on Tuesday for his bail application.
Sibiya disputes the allegations against him, describing the charges of rape, sexual grooming of a minor and human trafficking as unfounded.

His case centres partly on a sexually explicit video involving a minor that was found on his phone. Sibiya maintains that he has never had a sexual relationship with the girl.
He was arrested last week at a strip club in Sandton after police obtained evidence allegedly linking him to the sexual grooming of the minor.
State Alleges WhatsApp Exchanges With 16-Year-Old
The State alleges that Sibiya sexually groomed a 16-year-old girl who is the daughter of a close associate and exchanged sexually explicit images with her through WhatsApp.
It further alleges that Sibiya sent the teenager a video of herself masturbating.

Sibiya disputes that account. He told the court that the video had been sent to him by the girl's father, who he said was disappointed in his daughter and had confided in him.
Sibiya Explains How Video Reached His Phone
Sibiya's lawyer, Estelle Killian, read his affidavit to the court, setting out his explanation for receiving the video.
“He was disturbed and told me he received a video of his daughter masturbating from an undisclosed source. He forwarded this video to me while expressing his disappointment.”
Sibiya also claims that the girl's father told him his 16-year-old daughter had a crush on him.
According to Sibiya's account, he subsequently confronted the teenager about the alleged crush in WhatsApp messages.
The allegations against Sibiya have not been established in court. His bail hearing is due to continue on Thursday, when the court is expected to conclude proceedings on his application.
